User Terms and Conditions

1. Introduction
Welcome to Sinai! These Terms of Use (the "Terms") govern your use of Sinai's personalized streaming services, including any associated websites, applications, and content ("Sinai Service"). By accessing or using the Sinai Service, you agree to these Terms. If you do not agree, do not use the Sinai Service.

1.1 Service Provider:
The Sinai Service is provided by Sinai, registered at 124 City Road, EC1V 2NX, London, England.
1.2 Age and Eligibility Requirements:
To use the Sinai Service, you must:
- Be at least 13 years old (or the equivalent minimum age in your country).
- Have parental or guardian consent if you are a minor.
- Be capable of entering into a binding contract.
- Reside in a region where the Sinai Service is available.
1.3 Additional Terms:
Certain features of the Sinai Service may be subject to additional terms, which are incorporated by reference into these Terms.
2. The Sinai Service
2.1 Service Options:
Sinai offers both free and Paid Subscription plans. Features and availability may vary by plan. Additional promotional offers may be available periodically.
2.2 Trials:
Paid Subscriptions may include trial periods. Use of the service during a trial constitutes acceptance of these Terms and the Paid Subscription Terms.
2.3 Third-Party Integration:
The Sinai Service may integrate with third-party applications or devices. Your use of such services is subject to additional terms set by those third parties.
2.4 Service Limitations and Modifications:
We use reasonable care and skill to keep the Sinai Service operational and to provide you with a personalized, immersive audio experience. However, our service offerings and their availability may change from time to time and subject to applicable laws, without liability to you; for example:
- The Sinai Service may experience temporary interruptions due to technical difficulties, maintenance, testing, or updates, including those required to reflect changes in relevant laws and regulatory requirements.
- We aim to evolve and improve our Services constantly, and we may modify, suspend, or stop (permanently or temporarily) providing all or part of the Sinai Service (including particular functions, features, subscription plans, and promotional offerings).
- Sinai has no obligation to provide any specific content through the Sinai Service, and Sinai or the applicable owners may remove particular songs, videos, podcasts, and other Content without notice.
- Some content or features may not be available to all users or in all locations, and availability may depend on applicable laws, third-party agreements, or technical limitations.
If you have prepaid fees directly to Sinai for a Paid Subscription that Sinai discontinues prior to the end of your Pre-Paid Period (as defined in the Payments and Cancellations section below), Sinai will refund the prepaid fees for any unused part of your then-current Paid Subscription after such discontinuation. Your account and billing information must be up to date for us to issue a refund.
3. Using the Sinai Service
3.1 Account Creation:
Users must create an account with accurate and current information. Keep your credentials secure. Notify Sinai immediately of unauthorized use of your account.
3.2 User License:
Sinai grants you a limited, non-exclusive, revocable license for personal, non-commercial use of the Sinai Service. This license does not grant ownership of the Sinai software or content.
3.3 Payments and Subscriptions:
Subscription fees, billing cycles, and payment methods are detailed in the Paid Subscription Terms. Price changes will be communicated in advance. Users can cancel subscriptions at any time.
4. Content and Intellectual Property Rights
4.1 User Content:
Users may upload content ("User Content") to the platform. By doing so, you confirm that:
- You own or have the necessary rights to the content.
- Creators and Artists must confirm they hold all necessary rights.
- The content does not violate any laws, third-party rights, or these Terms.
4.2 License to Sinai:
You retain ownership of your User Content when you post it to the Sinai Service. However, to operate the Sinai Service effectively, you grant Sinai a non-exclusive, transferable, sub-licensable, royalty-free, fully paid, irrevocable, worldwide license to:
- Reproduce, make available, perform, display, translate, modify, create derivative works from, distribute, and otherwise use your User Content through any medium, whether alone or in combination with other Content or materials, in any manner and by any means, method, or technology, whether now known or hereafter created, in connection with the Sinai Service.
- Creators and Artists grant a non-exclusive license to Sinai to host, distribute, and monetize their content.
Where applicable and to the extent permitted under applicable law, you also waive and agree not to enforce any "moral rights" or equivalent rights (e.g., rights to attribution or objection to derogatory treatment) in your User Content.
4.3 Content Monitoring:
Sinai reserves the right to monitor and remove User Content that violates these Terms or applicable laws.
4.4 Sinai's Proprietary Rights:
All trademarks, service marks, and features of Sinai, along with the Sinai Service and its content, are owned by Sinai or its licensors. Users may not reproduce, distribute, or commercially exploit these assets without prior consent.
4.5 Infringement Reporting:
If you believe your intellectual property rights have been violated, refer to our Copyright Policy for reporting procedures.
5. Customer Support
For questions or complaints about your account or payments, contact Sinai Customer Support at info@sinaigospel.com.
EU residents may also file complaints via the EU Online Dispute Resolution platform.
6. Disputes and Limitations of Liability
6.1 Warranty Disclaimer:
Sinai will provide the Sinai Service using reasonable care and skill and in accordance with any specification of the Sinai Service provided by Sinai, however, subject to that, the Sinai Service is provided "as is" and "as available," without any warranties of any kind, whether express, implied, or statutory. Further, Sinai and all owners of the content disclaim any express, implied, and statutory warranties regarding the content, including warranties of satisfactory quality, merchantability, fitness for a particular purpose, or non-infringement.
Some jurisdictions do not allow the exclusion of implied warranties or limitations on applicable statutory rights of a consumer, so the exclusion and limitations in this section may not apply to you and nothing will affect your statutory rights.
6.2 Limitation of Liability:
Sinai's liability is limited to the greater of:
- The amount paid by you in the 12 months prior to the claim.
- £30.
Sinai is not liable for indirect or incidental damages, including lost profits or data.
6.3 Indemnification:
You agree to indemnify and hold Sinai harmless from and against any reasonably foreseeable direct losses, damages, and reasonable expenses (including reasonable attorney fees and costs) suffered or incurred by Sinai arising out of or related to: (1) your breach of any of these Terms (including any additional Sinai terms and conditions incorporated herein); (2) any User Content you post or otherwise contribute; (3) any activity in which you engage on or through the Sinai Service; and (4) your violation of any law or the rights of a third party.
6.4 Governing Law:
These Terms are governed by the laws of England and Wales. Disputes shall be resolved under exclusive jurisdiction in the courts of England and Wales, unless otherwise mandated by applicable laws.
6.5 Dispute Resolution:
Disputes will first undergo informal resolution. If unresolved, they will proceed to binding arbitration under UK law.
6.6 Arbitration:
Disputes may be subject to binding arbitration under the Rules of Arbitration of the International Chamber of Commerce (ICC).
7. Updates to Terms
Sinai reserves the right to update these Terms. Material changes will be communicated at least 30 days prior to implementation. Continued use of the Service after updates constitutes acceptance of revised Terms.
8. Final Provisions
8.1 Severability:
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in effect.
8.2 Assignment:
You may not assign these Terms without prior consent from Sinai. Sinai may assign these Terms as part of a business restructuring or sale.
8.3 Entire Agreement:
These Terms, along with the Privacy Policy, User Guidelines, and other referenced policies, constitute the entire agreement between you and Sinai.
